IN THE MATTER OF Railway Transport Committee Order No. R-41290 dated November 27, 1987, as amended by Order No. R-41376 dated December 18, 1987, which authorized, pursuant to section 253 of the Railway Act, R.S.C. 1970, c. R-2, the Canadian National Railway Company (hereinafter CN) to abandon the operation of the portion of the Lac St. Jean Subdivision from Ha Ha Bay Junction (mileage 205.65) to Chicoutimi (mileage 210.96), in the Province of Quebec, subject to the condition that an agreement between CN and VIA Rail Canada Inc. pursuant to clause 3 of Order No. R-41290 (as amended) be executed and that an Order be issued authorizing discontinuance of the Montreal-Chicoutimi passenger- train service between Jonquière (mileage 201.50) and Chicoutimi (mileage 210.96), Quebec;
IN THE MATTER OF a reconsideration of the application of CN, pursuant to section 260(8) of the Railway Act, for authority to discontinue passenger-train service operating between the terminal points of Chicoutimi and Montreal in the Province of Quebec, the responsibility for which is now shared by VIA Rail Canada Inc. (hereinafter VIA Rail) and CN effective April 1, 1979; and
IN THE MATTER OF Railway Transport Committee Order No. R-39638 dated August 6, 1986, which ordered the passenger-train service between Chicoutimi and Montreal to be continued.
WHEREAS no opposition was received from the general public subsequent to the issuance of the Railway Transport Committee's Notice of July 22, 1987, advertising the proposed discontinuance of passenger-train service between Jonquière and Chicoutimi, Quebec;
WHEREAS pursuant to clause 3 of Railway Transport Committee Order No. R-41290 dated November 27, 1987, as amended by Order No. R-41376 dated December 18, 1987, CN has executed an agreement with VIA Rail whereby CN will undertake to provide at Jonquière, Quebec for VIA Rail's use in the provision of its passenger-train service, the necessary facilities described in the Railway Transport Committee's Decision of November 4, 1987, at CN's expense, in accordance with the terms of the said agreement, on file with the Agency; and
WHEREAS the necessary facilities for parking, turning and maintaining the passenger-train will be installed by CN at Jonquière, Quebec on or before May 1, 1988, which will coincide with VIA Rail's schedule changes.
IT IS ORDERED THAT:
- CN and VIA Rail shall discontinue the operation of the passenger-train service between Jonquière (mileage 201.50) and Chicoutimi (mileage 210.96) in the Province of Quebec on May 1, 1988.
- CN is hereby authorized to abandon the operation of the portion of the Lac St. Jean Subdivision from Ha Ha Bay Junction (mileage 205.65) to Chicoutimi (mileage 210.96) in the Province of Quebec on May 1, 1988.
- CN and VIA Rail shall advise the Agency in writing of the date upon which the operation of the passenger-train service between Jonquière and Chicoutimi has been discontinued and the operation of the Lac St. Jean Subdivision between Ha Ha Bay Junction and Chicoutimi has been abandoned.
