Notice of Oral Hearing: Univar v. CP

NOTICE OF ORAL HEARING

Application by Univar Canada Ltd. (Univar) against Canadian Pacific Railway Company (CP), requesting that the Canadian Transportation Agency (Agency) find that CP has failed to fulfill its level of service obligations for the receiving, loading, carrying and delivering of traffic to and from its facility in Richmond, British Columbia and order CP to:

  • Repair the Marpole Rail Bridge and restore rail service forthwith, and to fulfil its level of service obligations to and from its facility.
  • Compensate Univar for all expenses it incurred due to CP’s service failure and to compensate for all expenses incurred by Univar until such time as CP has restored rail service to the facility. Univar requests that the compensation be paid by CP on a monthly basis.
  • Order such further and other relief the Agency deems just.
  • If the Agency does not award Univar compensation for its ongoing legal costs, then Univar seeks its costs of this proceeding.

The Agency will hold an oral hearing on Thursday, October 13, 2016, in Courtroom 601 at:

The hearing will begin at 1:00 p.m. and continue on Friday, October 14, 2016.

The Agency will hear oral arguments from counsel for both parties.

Attendance at the hearing

Members of the public may attend as observers of the hearing. The seating capacity in the public gallery of Courtroom 601 is for 40 people only, and will be filled on a first come basis. No outside cameras or recording devices are permitted.
