IN THE MATTER OF an application by the Nipissing Central Railway Company, pursuant to section 91 of the Canada Transportation Act, S.C., 1996, c. 10, for a certificate of fitness permitting it to operate a railway between Swastika, Ontario, and Rouyn/Noranda, Quebec.

The Nipissing Central Railway Company (hereinafer NCR) applied to the Canadian Transportation Agency (hereinafter the Agency) for the certificate set out in the title. The application was received on March 13, 1997.
Pursuant to Decision No. 411-R-1997 dated June 30, 1997, the Agency, based on an initial review of the material filed, issued interim Certificate of Fitness No. 97022(I) to NCR permitting it to operate a railway between Swastika, Ontario, and Rouyn/Noranda, Quebec, pending a further review of the application.
The Agency has undertaken and completed a more detailed review and is satisfied that there will be adequate third party liability insurance coverage, including self-insurance, for the proposed railway operation by NCR.
Accordingly, the Agency, pursuant to subsection 92(1) of the Canada Transportation Act, will issue a new certificate of fitness to NCR in replacement of Certificate of Fitness No. 97022(I) dated June 30, 1997.
Certificate of Fitness No. 97022(I) issued to NCR on June 30, 1997 is hereby cancelled.
In addition, the Agency will be requesting information from the Ontario Northland Railway regarding, among other matters, its operating relationship with NCR.
