APPLICATION by Air Transat A.T. Inc. carrying on business as Air Transat for authority to also operate services on the routes Toronto-Manzanillo, Mexico and Winnipeg-Puerto Vallarta, Mexico under Licence No. 030163.

Air Transat A.T. Inc. carrying on business as Air Transat (hereinafter Air Transat) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on November 25, 2004.
Under Licence No. 030163, Air Transat is authorized to operate a scheduled international service, large aircraft, in accordance with the Air Transport Agreement between the Government of Canada and the Government of the United Mexican States signed on December 21, 1961, as amended (hereinafter the Agreement).
Condition No. 1 of Licence No. 030163 states:
The Licensee is authorized to operate a scheduled international service on the following routes:
- Montréal - Cancun
- Toronto - Cancun
- Vancouver - Cancun
- Calgary - Cancun
- Edmonton - Cancun
- Québec - Cancun
- Halifax - Cancun
- Montréal - Puerto Vallarta
- Toronto - Puerto Vallarta
- Vancouver - Puerto Vallarta
- Calgary - Puerto Vallarta
- Edmonton - Puerto Vallarta
- Montréal - Acapulco
- Toronto - Acapulco
- Montréal - Zihuatanejo
- Toronto - Zihuatanejo
- Montréal - Manzanillo
- Montréal - Huatulco
By letter dated October 18, 2004, the Minister of Transport designated Air Transat to operate own aircraft scheduled air services between Toronto and Manzanillo and between Winnipeg and Puerto Vallarta.
The Agency has reviewed and considered the application and material in support thereof and is satisfied that Air Transat meets the requirements of paragraph 69(1)(a) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA).
Accordingly, pursuant to subsection 71(1) of the CTA, the Agency will issue a new document of licence authorizing Air Transat to operate a scheduled international service, large aircraft, subject to the following conditions:
- The Licensee is authorized to operate a scheduled international service on the following routes:
- Montréal - Cancun
- Toronto - Cancun
- Vancouver - Cancun
- Calgary - Cancun
- Edmonton - Cancun
- Québec - Cancun
- Halifax - Cancun
- Montréal - Puerto Vallarta
- Toronto - Puerto Vallarta
- Vancouver - Puerto Vallarta
- Calgary - Puerto Vallarta
- Edmonton - Puerto Vallarta
- Winnipeg - Puerto Vallarta
- Montréal - Acapulco
- Toronto - Acapulco
- Montréal - Zihuatanejo
- Toronto - Zihuatanejo
- Montréal - Manzanillo
- Toronto - Manzanillo
- Montréal - Huatulco
- The operation of the scheduled international service authorized herein shall be conducted subject to the provisions of the Agreement and to any applicable arrangements as may be agreed to between Canada and Mexico.
- Unless terminated at an earlier date in accordance with the CTA or the Agreement, this licence shall terminate at the termination or expiration of the Agreement, or upon the effective date of any amendment to the Agreement which shall have the effect of eliminating the rights herein authorized.
