APPLICATION by Skyservice Airlines Inc. carrying on business as Skyservice pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, to vary Order No. 2006-A-418 dated August 31, 2006 to reflect a change in the display on its aircraft.

On November 23, 2006, Skyservice Airlines Inc. carrying on business as Skyservice (hereinafter Skyservice) applied to the Canadian Transportation Agency (hereinafter the Agency) for the variance set out in the title.
By Order No. 2006-A-418 dated August 31, 2006, Skyservice was, subject to certain conditions, granted an exemption from the application of paragraph 18(c) of the Air Transportation Regulations, SOR/88-58, as amended (hereinafter the ATR) to permit Skyservice to operate its scheduled international service, large aircraft, between points in Canada and points in Italy using aircraft displaying the name and the internet address "Conquest", the name, internet address and design logo of "Signature"; the name and internet address of "Sunquest"; along with the slogan "good to go..." and the names of Sunquest's sister companies "Alba Tours" or "Tours Maison"; or the name, internet address and design logo of "Sunwing".
Skyservice has requested that Order No. 2006-A-418 be varied in order that it may, in the operation of its scheduled international service, large aircraft, between Canada and the Italy, now display the names "My Sunquest" and "My Alba Tours" instead of "Sunquest" and "Alba Tours" and no longer display the advertising labels "good to go..." and the name "Tours Maison".
The Agency has carefully considered the matter and finds, pursuant to section 32 of the Canada Transportation Act (hereinafter the CTA), that there has been a change in the facts and circumstances pertaining to Order No. 2006-A-418 since it was issued and that it should be varied.
Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Order No. 2006-A-418 by allowing Skyservice, in the operation of its scheduled international service, large aircraft, between points in Canada and points in Italy under Licence No. 060035, to now display the names "My Sunquest" and "My Alba Tours" instead of "Sunquest" and "Alba Tours" and to no longer display the advertising labels "good to go..." and the name "Tours Maison".
All other conditions set out in Order No. 2006-A-418 remain unchanged.
A copy of this Decision shall be carried on board the aircraft and be provided to foreign authorities upon request.
