APPLICATION by Canadian Airlines International Ltd. carrying on business under the firm name and style of either Canadian Airlines International or Canadi*n to amend Licence No. 890471 to reflect Canada's International Air Transportation Policy dated December 20, 1994 by removing the restriction that no intermediate point or points beyond the United Kingdom territory may be served.

Canadian Airlines International Ltd. carrying on business under the firm name and style of either Canadian Airlines International or Canadi*n ( The Company's symbol appears between the "i" and the "n" in the trade name.) (hereinafter the applicant) has applied to the National Transportation Agency for amendment of its Licence No. 890471 in order to reflect the policy statement by the Minister of Transport dated December 20, 1994, that all Canadian air carriers will be permitted to make use of available intransit rights.

Condition No. 1 of Licence No. 890471 authorizes the applicant to operate a scheduled international service on the routes set out below:

Points of Departure

  • Any point or points in Canada

Points in the United Kingdom

  • Any point or points in the United Kingdom

No intermediate points or points beyond the United Kingdom territory may be served on this route.

The Agency deems it appropriate in the public interest to amend Licence No. 890471 to reflect the policy statement by the Minister of Transport dated December 20, 1994, by amending Condition No. 1 to authorize the Licensee to operate the routes set out in the Agreement thereby removing the restriction on serving intermediate points and points beyond and by adding a new condition permitting the carriage of traffic intransit through points in the United Kingdom of Great Britain and Northern Ireland (United Kingdom). Accordingly, a new document of licence bearing Licence No. 890471 will be issued to the applicant.

Pursuant to subsection 91(1) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), Condition No. 1 of Licence No. 890471 is hereby amended to read:

  1. The Licensee is authorized to operate the routes set out in the Agreement.

    In addition, Licence No. 890471 is hereby amended by renumbering Condition Nos. 2 and 3 as Condition Nos. 3 and 4 respectively and by adding a new Condition No. 2:

  2. In respect of intermediate points and points beyond the United Kingdom territory, the Licensee may carry intransit traffic originating in or destined for points in third countries. No fifth freedom traffic may be carried between intermediate points and points in the United Kingdom or between points in the United Kingdom and points beyond.
