APPLICATION by Air Transat A.T. Inc. carrying on business as Air Transat for extra-bilateral authority pursuant to subsection 78(2) of the Canada Transportation Act, S.C., 1996, c. 10, to operate the route Toronto - Dublin - Shannon - Toronto while providing its scheduled international service between Canada and Ireland, from May 14 to October 16, 2005.

Air Transat A.T. Inc. carrying on business as Air Transat (hereinafter Air Transat) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on February 8, 2005.

Under Licence No. 020130, Air Transat is authorized to operate a scheduled international service, large aircraft, in accordance with the Agreement between the Government of Canada and the Government of Ireland for Air Services signed on August 8, 1947 (hereinafter the Agreement).

Condition No. 1 of Licence No. 020130 states:

The Licensee is authorized to operate the route(s) set out in the Agreement.

Under the terms of the Agreement, the specified route to be operated by the designated airline or airlines of the Government of Canada shall be Montréal via intermediate points to Shannon and points in countries beyond in both directions. Further, the Agreement requires that all eastbound aircraft on the routes covered in the Annex shall stop at Shannon Airport and all westbound aircraft on the same routes shall stop at Shannon Airport.

The Agency may grant temporary authority pursuant to section 78(2) of the Canada Transportation Act (hereinafter the CTA) for a service which is not permitted in a bilateral air transport agreement.

The Agency has reviewed and considered the application and is satisfied that the amendment of Licence 020130 to permit the operation of Air Transat's scheduled international service on the route Toronto-Dublin-Shannon-Toronto would be beneficial to the travelling public.

Accordingly, the Agency, pursuant to subsection 78(2) of the CTA, hereby varies Condition No. 1 of Licence No. 020130 to the extent necessary to permit Air Transat to operate the route Toronto-Dublin- Shannon-Toronto while providing its scheduled international service between Canada and Ireland, from May 14 to October 16, 2005.

In all other respects, the service(s) shall be operated in accordance with the Agreement.

The authority granted herein does not exempt Air Transat from the requirements of other legislative acts or regulations, including those of Transport Canada.

This Decision shall form part of Licence No. 020130 and shall remain affixed thereto as long as this Decision is in force.
