APPLICATION by Enterprise Air Inc. for authority to also operate a Class 9-4 Charter non-scheduled international service between points in Canada and points in the United States of America using fixed wing aircraft in Group D under Licence No. 940296.

Enterprise Air Inc. (hereinafter the applicant) has applied to the National Transportation Agency for authority to operate the service set out in the title. The application was received on February 8, 1996.
Under Licence No. 940296, the applicant is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups B and C (limited to the transportation of goods only in Group C).
The Agency has reviewed the application and considers that public notice of the application need not be given, as proposed operations are between points in Canada and points in the United States of America only. As such, and based on the open access available to Canadian air carriers under the Air Transport Agreement between the Government of Canada and the Government of the United States of America dated February 24, 1995, the Agency has determined pursuant to subsection 94(1) of the National Transportation Act, 1987 (hereinafter the NTA, 1987) that it is in the public interest to issue to the applicant a new document of licence bearing Licence No. 940296.
The applicant has also filed the material necessary to complete its application. The Agency has reviewed the material filed and is satisfied that the applicant meets the requirements set out in subsection 94(1) of the NTA, 1987.
In accordance with the applicant's indicated intentions, the Agency finds it in the public interest to authorize the Licensee to also use fixed wing aircraft in Group D, limited to the operation of air transportation between points in Canada and points in United States of America.
Condition No. 1 of Licence No. 940296 is hereby amended to read:
The Licensee is authorized to use fixed wing aircraft in Groups B, C (limited to the transportation of goods in Group C) and D (limited to the operation of air transportation between points in Canada and points in the United States of America in Group D).
Accordingly, a new document of licence bearing Licence No. 940296 will be issued to Enterprise Air Inc.
