APPLICATION by Cargolux Airlines International, S.A. for extra-bilateral authority pursuant to subsection 78(2) of the Canada Transportation Act, S.C., 1996, c. 10, to operate an additional weekly all-cargo flight on the route Seattle - San Francisco - Calgary - Luxembourg, with no fifth freedom traffic rights, commencing on March 31, 2007.

Cargolux Airlines International, S.A. (hereinafter Cargolux) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on February 22, 2007.
The Agency notes that this application is for a renewal of the authority granted by Decision No. 193-A-2006 dated March 29, 2006.
Under Licence No. 030143, Cargolux is authorized to operate a scheduled international service between Luxembourg and Canada in accordance with the Memorandum of Understanding between the Government of Canada and the Government of the Grand Duchy of Luxembourg on Scheduled Air Services signed on June 23, 2003 (hereinafter the Memorandum of Understanding.
Condition No. 1 of Licence No. 030143 states:
The Licensee is authorized to operate the route(s) set out in the Memorandum of Understanding.
As the proposed service is not provided for in the Memorandum of Understanding and requires extra-bilateral authority, notice of the application was given to Canadian air carriers and to The Calgary Airport Authority by letter dated February 26, 2007. No objections were received.
The Agency may grant temporary authority pursuant to subsection 78(2) of Canada Transportation Act (hereinafter the CTA), for a service which is not permitted in an agreement or arrangement relating to civil aviation to which Canada is a party.
The Agency has reviewed and considered the application and the material filed in support thereof and is satisfied that extra-bilateral authority to operate an additional weekly all-cargo flight on the route Seattle - San Francisco - Calgary - Luxembourg, with no fifth freedom traffic rights, would be beneficial to shippers and regional economic development.
Accordingly, the Agency, pursuant to subsection 78(2) of the CTA, hereby varies Condition No. 1 of Licence No. 030143 to allow the operation of an additional weekly all-cargo flight on the route Seattle - San Francisco - Calgary - Luxembourg on which no fifth freedom traffic rights shall be exercised between Calgary and points in the United States of America, from March 31, 2007 to March 31, 2008.
This Decision shall form part of Licence No. 030143 and remain affixed thereto until March 31, 2008.
