Decision No. 134-A-2012
APPLICATION by Discovery Air International Inc., pursuant to section 61 of the Canada Transportation Act, S.C., 1996, c. 10, as amended.
Discovery Air International Inc. (applicant) has applied to the Canadian Transportation Agency (Agency) for a licence to operate a domestic service, small aircraft.
To meet the requirement to hold a valid Canadian aviation document set out in subparagraph 61(a)(ii) of the Canada Transportation Act (CTA), the applicant submitted a document issued to it by the Minister of Transport dated March 26, 2012 which refers to an agreement between the applicant and Air Tindi Ltd. (Air Tindi) dated February 10, 2012.
The Agency has considered the document and is satisfied that it is a Canadian aviation document within the meaning of the CTA.
The Agency is also satisfied that the applicant meets all the remaining applicable requirements of section 61 of the CTA.
Further, with respect to this application, the applicant has undertaken that it will not contravene section 59 of the CTA prior to the issuance of the applied for licence.
Accordingly, the Agency approves the application for a licence to operate a domestic service, small aircraft.
In addition, to ensure continued compliance with subparagraph 61(a)(ii) of the CTA, the Agency, pursuant to sections 25 and 28 of the CTA, orders the applicant to provide the Agency with any documentation, immediately upon execution, that has the effect of altering or proposing to alter the agreement between the applicant and Air Tindi or would indicate that the applicant has entered into or is proposing to enter into a similar arrangement with a third party.
Also, the applicant is prohibited from providing its domestic service, small aircraft, under Licence No. 120024, using all or part of an aircraft, with flight crew, that have been provided to Air Tindi by another person.
This Decision shall form part of Licence No. 120024.
