APPLICATION by Beaver Air Services Ltd. for cancellation of Licence Nos. 883280 and 883281 in respect of the authority to use fixed wing aircraft in Group C.

Beaver Air Services Ltd. (hereinafter the Licensee) has applied to the National Transportation Agency for the cancellation set out in the title. The application was received on December 12, 1990.
Under Licence No. 883280, the Licensee is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups A, B and C, from a base at The Pas, Manitoba.
Under Licence No. 883281, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups A, B and C.
By Decision No. 581-A-1989 dated November 17, 1989, Licence Nos. 883280 and 883281 in respect of the authority to use fixed wing aircraft in Group C were suspended pursuant to subsections 75(2) and 97(2), respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.). The Licensee was required to file within one year from the date of the Decision an application to reinstate the suspended services which would establish to the satisfaction of the Agency that it still has the qualifications necessary for the issuance of the licences namely that it is Canadian, holds a Canadian aviation document (operating certificate) and a valid certificate of insurance; and, alternatively, the Licensee was required to show cause within that same period why its licences in respect of the authority to use fixed wing aircraft in Group C should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the National Transportation Act, 1987, as failure to file the said application would give reasonable grounds to the Agency to believe that, in respect of the services using fixed wing aircraft in Group C authorized under Licence Nos. 883280 and 883281, the Licensee ceases to have the qualifications necessary for the issuance of the licences.
By letter dated December 6, 1990, the Licensee requested the cancellation of Licence Nos. 883280 and 883281 in respect of the authority to use fixed wing aircraft in Group C.
The Agency has reviewed the application and considers it appropriate to cancel Licence Nos. 883280 and 883281 in respect of the authority to use fixed wing aircraft in Group C. The application is hereby approved.
Licence Nos. 883280 and 883281 in respect of the authority to use fixed wing aircraft in Group C are hereby cancelled pursuant to subsections 75(2) and 97(2), respectively, of the National Transportation Act, 1987.
New documents of licence, bearing Licence Nos. 883280 and 883281, will issue.
