IN THE MATTER OF the application of the Canadian National Railway Company, on behalf of Ultramar Canada Inc. (hereinafter the Applicant) for authority to construct and operate an installation for the transfer of flammable liquids at Amos, in the Province of Quebec, near mileage 41.48 Taschereau Subdivision of the Canadian National Railway Company, as shown on the Applicant's Drawing No. 77-2054, revised November 18, 1987 on file with the Agency under File No. 28638.2.1569; and

IN THE MATTER OF Clause 1 of Order No. 98473 of the Board of Transport Commissioners for Canada, dated July 13, 1959.

WHEREAS the Agency is aware that the said installation has been constructed and has been placed in operation prior to approval of the Agency having been obtained; and

WHEREAS the Agency is satisfied that the operation of the said installation will not affect the safety of the public or the employees of the Railway Company.

UPON reading the submissions filed,

IT IS ORDERED THAT:

  1. The National Transportation Agency approves, pursuant to subsection 44(3) of the National Transportation Act, 1987, S.C. 1987, c. 34, the works already completed, as shown on the said Drawing, and in service; and the Applicant is hereby authorized to operate the said installation for the transfer of flammable liquids as shown on the said Drawing.
  2. The installation shall be maintained and operated in accordance with the requirements of the Flammable Liquids Bulk Storage Regulations General Order No. 0-32, C.R.C. 1978, c. 1148.
  3. Clause 1 of Order No. 98473 of the Board of Transport Commissioners for Canada, dated July 13, 1959, is hereby rescinded.
