IN THE MATTER OF the payment of the cost of the operation and maintenance of the protective devices at the crossing at grade of Highway No. 9 and the right-of-way and track of Canadian Pacific Limited, at mileage 36.02 Owen Sound Subdivision, in the Town of Orangeville, in the Province of Ontario.

WHEREAS by Order No. 96309 of the Board of Transport Commissioners for Canada, dated November 20, 1958, fifty per cent of the said cost was placed upon Canadian Pacific Limited and fifty per cent was placed upon the Ministry of Transportation and Communications; and

WHEREAS the Agency has been advised that responsibility for maintenance at the location of the said crossing now rests with the Town of Orangeville.

UPON reading the submissions filed,

IT IS ORDERED THAT:

On and after March 7, 1985, fifty per cent of the cost of operation and maintenance of the said protective devices shall be paid by the Town of Orangeville and fifty per cent of the said cost shall be paid by Canadian Pacific Limited.
