IN THE MATTER OF the application of D.S. - Lea Associates Ltd., on behalf of the Canadian National Railway Company (hereinafter the Applicant) for authority to reconstruct the pedestrian overhead bridge across and over the tracks of the Toronto Terminals Railway Company and the Applicant's Oakville Subdivision, at mileage 0.40, as shown on Drawing Nos.

on file with the Agency under File No. 26711.3600 and to operate under the said pedestrian overhead bridge during the period of reconstruction.

WHEREAS the Applicant has filed details of the special measures to be undertaken during the period of reconstruction and the Agency is satisfied that their adoption will secure the protection and safety of the public.

UPON reading the submissions filed,

IT IS ORDERED THAT:

  1. The Applicant is authorized to reconstruct the said pedestrian overhead bridge, as shown on the said Drawings.
  2. The said pedestrian overhead bridge shall be reconstructed in compliance with the requirements of the Railway Grade Separations Regulations General Order No. E-5, C.R.C. 1978, c. 1191.
  3. The cost of reconstruction of the said pedestrian overhead bridge shall be paid by the Applicant.
  4. The cost of maintenance of the said reconstructed pedestrian overhead bridge shall be paid by the Applicant.
  5. Subject to the conditions contained in this Order, the Applicant and the Toronto Terminals Railway Company may operate trains at the said location during the period of reconstruction of the said pedestrian bridge.
  6. During the period of reconstruction of the said pedestrian bridge, the Applicant shall take such special measures as are set forth by D.S. - Lea Associates Ltd. in its letter of
