IN THE MATTER OF the application of the Ministry of Transportation and Communications of the Province of Ontario, hereinafter called the "Applicant", for authority to reconstruct the overhead bridge carrying Highway No. 2 across and over the right of way and tracks of the Canadian National Railway Company, hereinafter called the "Railway", in the City of Kingston, in the Province of Ontario, at mileage 176.29 Kingston Subdivision, as shown on Plan No. G-8003-1, dated August, 1987, on file with the Agency under File No. 9437.559.

UPON reading the submissions filed and upon the consent of the Applicant,
IT IS ORDERED THAT:
- The Applicant is authorized to reconstruct the said overhead bridge, as shown on the said Plan.
- The said overhead bridge shall be reconstructed in compliance with the requirements of the Railway Grade Separations Regulations General Order No. E-5, C.R.C. 1978, c. 1191. Detailed plans shall be submitted to, and approved by, an Engineer of the Agency before reconstruction is commenced.
- The cost of reconstruction shall be paid by the Applicant.
- The cost of maintenance of the said reconstructed overhead bridge shall be paid by the Applicant.
- The Railway is directed to prepare all accounts using rates not in excess of those stipulated in Schedule "A" entitled Directives, attached to Railway Transport Committee Order No. R-40670 dated May 20, 1987, or its replacement, for all construction and maintenance work carried out by the Railway under this Order.
