IN THE MATTER OF Canadian Transport Commission Order Nos. WDR1987-342 dated December 29, 1987 and WDR1987-341 dated December 29, 1987, which ordered, respectively, the continuation of the operation of Canadian Pacific Limited's (hereinafter CP) Altawan Subdivision, between mileage 65.7 and mileage 122.1, in the Provinces of Saskatchewan and Alberta, and the continuation of the operation of CP's Kisbey Subdivision, between mileage 43.6 and mileage 60.9, in the Province of Saskatchewan; and

IN THE MATTER OF CP's applications of March 30, 1989, in respect of Altawan Subdivision, and April 14, 1989, in respect of Kisbey Subdivision, for the abandonment of the operation of these lines.

WHEREAS CP is requesting that the Agency authorize the abandonment of the lines in question which were originally ordered retained; and

WHEREAS the Agency has found that pursuant to section 41 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), new facts or circumstances have arisen since Canadian Transport Commission Order Nos. WDR1987-342 and WDR1987-341 issued.

UPON consideration of the material received and on file related to the subject applications,

THE AGENCY HEREBY ORDERS THAT:

Canadian Transport Commission Order Nos. WDR1987-342 and WDR1987-341 both dated December 29, 1987 are varied and CP is authorized to abandon the operation of the Altawan Subdivision between mileage 65.7 and mileage 122.1, and the Kisbey Subdivision between mileage 43.6 and mileage 60.9.

CP shall abandon the operation of the Altawan Subdivision between mileage 65.7 and mileage 122.1 and the Kisbey Subdivision between mileage 43.6 and mileage 60.9, thirty (30) days from the date of this Order.

CP shall advise the Agency in writing of the dates upon which:

i) the operation of the Altawan and Kisbey Subdivisions as specified have been abandoned, and

ii) the trackage and other facilities were removed.
