WHEREAS under Licence No. 883422, Kayahn-Air Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group A from a base at Big Trout Lake, Ontario;

AND WHEREAS under Licence No. 883424, the Licensee is authorized to operate a domestic service;

AND WHEREAS under Licence No. 883423, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group A;

AND WHEREAS by registered letter dated August 14, 1989, the Licensee was required to show cause by September 4, 1989 why Licence Nos. 883422, 883424 and 883423 should not be suspended or cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS to date, the Licensee has failed to reply to the aforementioned letter;

AND WHEREAS Transport Canada has advised the Agency that the Licensee's Operating Certificate has been cancelled;

AND WHEREAS the Agency has determined that the Licensee ceases to have the qualifications necessary for the issuance of the said licences;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 883422, 883424 and 883423 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

1. Licence Nos. 883422 and 883424 are hereby suspended pursuant to paragraph 75(1)(a) of the National Transportation Act, 1987, and Licence No. 883423 is hereby suspended pursuant to paragraph 97(1)(a) of the National Transportation Act, 1987.
2. The Licensee is hereby required to show cause within 30 days from the date of this Order why the said licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a) of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 883422, 883424 and 883423 and shall remain affixed thereto as long as the said Order is in force.
