IN THE MATTER OF a review of the Annex attached to Order No. 1988-A-754 dated August 24, 1988.

WHEREAS by Order No. 1988-A-754 dated August 24, 1988, relating to a complaint by Air Canada against British Airways' marketing and sale of its "London Plus" promotion, the National Transportation Agency, inter alia, interpreted and established criteria for the evaluation and filing of tariffs under the Canada-United Kingdom Air Services Agreement (hereinafter the Agreement);

AND WHEREAS the Agency established, inter alia, that tariffs for Canada-United Kingdom-third country services are to be filed by carriers designated by the United Kingdom authorities pursuant to Article 13, paragraph 10(a) of the Agreement if the tariffs are to a point within a state which has direct air links with Canada across the Atlantic Ocean;

AND WHEREAS the Annex to Order No. 1988-A-754 lists the countries with whom Canada had direct Transatlantic air links at the time of writing of the Order and stipulates that the Annex will be modified by the Agency as air links will evolve;

AND WHEREAS the Agency has been requested to approve that Denmark, Pakistan and Sweden be added to the list of countries with whom Canada has direct Transatlantic air links;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to add Denmark, Pakistan and Sweden to the list of countries with whom Canada has direct Transatlantic air links set out in the Annex to Order No. 1988-A-754.

NOW THEREFORE, IT IS ORDERED THAT:

  1. The Annex attached to Order No. 1988-A-754 dated August 24, 1988 is hereby amended by adding Denmark, Pakistan and Sweden to the list of countries with whom Canada has direct Transatlantic air links.
  2. The Annex to Order No. 1988-A-754 dated August 24, 1988, as amended by this Order, is attached hereto.
