WHEREAS under Licence No. 883133, I.M.P. Group Limited (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups B and C, from a base at Halifax, Nova Scotia;

AND WHEREAS under Licence No. 883134, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups B and C;

AND WHEREAS under Licence No. 883135, the Licensee is authorized to operate a domestic service;

AND WHEREAS by Order No. 1989-A-325 dated October 19, 1989, Licence Nos. 883133 and 883135 were suspended pursuant to paragraph 75(1)(a) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987), and Licence No. 883134 was suspended pursuant to paragraph 97(1)(a) of the NTA, 1987, for a period of six months from the date of the Order, and the Licensee was required to show cause within the same period, why the said licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the NTA, 1987;

AND WHEREAS by letter dated March 28, 1990, the Licensee has requested a further suspension of Licence Nos. 883133, 883134 and 883135 for a period of six months;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 883133, 883134 and 883135 until October 19, 1990.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence Nos. 883133 and 883135 are hereby suspended, pursuant to paragraph 75(1)(a) of the NTA, 1987 and Licence No. 883134 is hereby suspended pursuant to paragraph 97(1)(a) of the NTA, 1987, until October 19, 1990.
  2. The Licensee is hereby required to file on or before October 19, 1990 an application to reinstate the suspended services. When the Agency is satisfied, based upon material on file or from information specifically requested from the Licensee, that the Licensee has the qualifications necessary for the issuance of the licences, namely that it is a Canadian, holds a Canadian aviation document (operating certificate) and has prescribed liability insurance coverage, the Agency shall reinstate the suspended services.
  3. Alternatively, if no application is filed, the Licensee is required to show cause on or before October 19, 1990 why its licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the NTA, 1987, as failure to meet any of the above requirements would give reasonable grounds to the Agency to believe that the Licensee ceases to have the qualifications necessary for the issuance of the licences.

This Order shall form part of Licence Nos. 883133, 883134 and 883135 and shall remain affixed thereto as long as this Order is in force.
