IN THE MATTER OF the installation by the Communauté Régionale de l'Outaouais (hereinafter the Communauté) of two sanitary pipes along the right-of-way and bridge of Canadian Pacific Limited (hereinafter the railway company), at mileage 115.9 Lachute Subdivision, over the Gatineau River, in the Province of Quebec, as shown on Plan Nos. 13 and 14 both dated July 1984 and Plan No. 28 dated August 24, 1983 (hereinafter the Plans), on file with the Agency.

WHEREAS the Communauté has carried out the works without obtaining leave of the Agency pursuant to section 212 and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3;

AND WHEREAS the Communauté has filed details of the work that has been carried out;

AND WHEREAS the railway company has no objection to the completed work;

AND WHEREAS the Agency has reviewed the submissions filed.

NOW THEREFORE, IT IS ORDERED THAT:

Pursuant to subsection 44(3) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.):

  1. The work is approved.
  2. The cost of installing and maintaining the two sanitary pipes shall be paid by the Communauté.
