IN THE MATTER OF the operation of a Class 4 Charter domestic service, a Class 9-4 Charter non-scheduled international service and a domestic service by Burrard Air Ltd. - Licence Nos. 883633, 883634 and 883635.

WHEREAS under Licence No. 883633, Burrard Air Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups A, B and C, from a base at Victoria, British Columbia;
AND WHEREAS under Licence No. 883634, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups A, B and C;
AND WHEREAS under Licence No. 883635, the Licensee is authorized to operate a domestic service;
AND WHEREAS Transport Canada advised the Agency that the Licensee no longer holds a valid operating certificate;
AND WHEREAS the Agency has determined that the Licensee ceases to have the qualifications necessary for the issuance of the said licences;
AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 883633, 883634 and 883635 and to require the Licensee to show cause why the said licences should not be cancelled.
NOW THEREFORE, IT IS ORDERED THAT:
- Licence Nos. 883633 and 883635 are hereby suspended pursuant to paragraph 75(1)(a) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) and Licence No. 883634 is hereby suspended pursuant to paragraph 97(1)(a) of the National Transportation Act, 1987.
- The Licensee is hereby required to show cause within thirty (30) days from the date of this Order why the said licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the National Transportation Act, 1987.
This Order shall form part of Licence Nos. 883633, 883634 and 883635 and shall remain affixed thereto as long as the said Order is in force.
