IN THE MATTER OF Decision No. 9760 dated May 7, 1986 - 614343 Ontario Limited carrying on business under the firm name and style of Trillium Air.

WHEREAS by Decision No. 9760 dated May 7, 1986, 614343 Ontario Limited carrying on business under the firm name and style of Trillium Air (hereinafter the applicant) was granted authority to operate a Class 4 Charter commercial air service wholly within Southern Canada and a Class 9-4 International Charter commercial air service to transport persons and goods on Advance Booking Charters, Inclusive Tour Charters, Common Purpose Charters and Entity Charters between points in Canada and any other country, both services using fixed wing aircraft in Groups F and G from a base at Hamilton, Ontario, subject to meeting the requirements of the Canadian Transport Commission as applicable;

AND WHEREAS on several occasions the Canadian Transport Commission advised the applicant of the requirements to be met with respect to licence issuance;

AND WHEREAS by letter dated February 26, 1988, the applicant was advised of the requirements for licence issuance of the National Transportation Agency;

AND WHEREAS by registered letter dated August 15, 1990, the applicant was required to show cause within thirty (30) days from the date of the letter why Decision No. 9760 should not be rescinded, pursuant to section 41 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS to date the applicant has failed to either establish to the satisfaction of the Agency that it has the qualifications necessary for licence issuance or to respond to the aforementioned show cause letter;

AND WHEREAS the Agency has considered the matter and is of the opinion that Decision No. 9760 should be rescinded.

NOW THEREFORE, IT IS ORDERED THAT:

Decision No. 9760 dated May 7, 1986 is hereby rescinded.
