IN THE MATTER OF the operation of a domestic service and a Class 9-4 Charter non-scheduled international service by Metro Jet Inc. - Licence Nos. 880468 and 890168.

WHEREAS under Licence No. 880468, Metro Jet Inc. (hereinafter the Licensee) is authorized to operate a domestic service;

AND WHEREAS under Licence No. 890168, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group D;

AND WHEREAS by letter dated June 21, 1990, the Licensee was required to show cause by no later than July 12, 1990 why Licence Nos. 880468 and 890168 should not be suspended or cancelled, pursuant to subsections 75(1) and 97(1), respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), as Transport Canada had advised the National Transportation Agency that the operating certificate of the Licensee was suspended effective May 23, 1990;

AND WHEREAS by letter dated July 16, 1990, the Licensee advised the Agency that it was in the process of reinstating its operating certificate with Transport Canada and requested that the Agency take no further action as it intends to resume operation of its services;

AND WHEREAS by letter dated August 31, 1990, Transport Canada advised the Agency that the operating certificate of the Licensee has been cancelled effective August 30, 1990;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the licences;

AND WHEREAS the Agency considers it appropriate to suspend Licence Nos. 880468 and 890168 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence Nos. 880468 and 890168 are hereby suspended pursuant to paragraphs 75(1)(a) and 97(1)(a), respectively, of the National Transportation Act, 1987.
  2. The Licensee is hereby required to show cause within twenty-one (21) days from the date of this Order why the said licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), respectively, of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 880468 and 890168 and shall remain affixed thereto as long as the said Order is in force.
