IN THE MATTER OF Decision No. 11125 dated November 5, 1987 - 614343 Ontario Limited carrying on business under the firm name and style of Trillium Air.

WHEREAS under Licence No. A.T.C. 4036/86(SC), 614343 Ontario Limited carrying on business under the firm name and style of Trillium Air (hereinafter the Licensee) was authorized to to operate a Class 4 Charter commercial air service wholly within Southern Canada, using fixed wing aircraft in groups B and C, from a base at Toronto, Ontario; and under Licence No. 971/86(SCF), a Class 9-4 International Charter commercial air service restricted to flights originating or terminating at a point in Southern Canada, using the same aircraft, from the same base;
AND WHEREAS by Decision No. 11125 dated November 5, 1987, the Licensee was granted authority to also use fixed wing aircraft in Groups D and E under Licence Nos. A.T.C. 4036/86(SC) and A.T.C. 971/86(SCF), subject to meeting the requirements of the Canadian Transport Commission as applicable;
AND WHEREAS by letter dated March 17, 1988, the Licensee was advised of the requirements for licence issuance of the National Transportation Agency;
AND WHEREAS by registered letter dated November 18, 1988, the Licensee was required to either meet the outstanding requirements of the Agency within thirty (30) days from the date of the letter or to show cause by that same date why Decision No. 11125 should not be rescinded for failure to meet the Agency's requirements;
AND WHEREAS the Agency's show cause letter dated November 18, 1988 was returned to the Agency postmarked by Canada Post Corporation as "Moved address unknown";
AND WHEREAS the Agency notes that Licence Nos. A.T.C. 4036/86(SC) and A.T.C. 971/86(SCF) were not replaced by licences of the Agency pursuant to the provisions of subsection 109(3) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), as the Licensee did not meet the licence issuance requirements of the Agency;
AND WHEREAS the Agency has considered the matter and is of the opinion that Decision No. 11125 should be rescinded.
NOW THEREFORE, IT IS ORDERED THAT:
Decision No. 11125 dated November 5, 1987 is hereby rescinded.
