IN THE MATTER OF Decision Nos. 9526 dated February 12, 1986 and 9667 dated April 4, 1986 - Peninsulair Limited.

WHEREAS by Decision No. 9526 dated February 12, 1986, Peninsulair Limited (hereinafter the applicant) was granted authority to operate a Class 9-3 International Specific Point commercial air service serving the points Hamilton, Ontario, Canada and Erie, Pennsylvania, U.S.A. using fixed wing aircraft certificated as capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds, subject to meeting the requirements of the Canadian Transport Commission as applicable;

AND WHEREAS by Decision No. 9667 dated April 4, 1986, the applicant was granted authority to operate a Class 9-3 International Specific Point commercial air service serving the points Hamilton, Ontario, Canada and Buffalo, New York, U.S.A. using fixed wing aircraft certificated as capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds, subject to meeting the requirements of the Canadian Transport Commission as applicable;

AND WHEREAS by letter dated March 4, 1988, the applicant was advised of the requirements for licence issuance of the National Transportation Agency;

AND WHEREAS by registered letter dated August 17, 1990, the applicant was required to show cause within thirty (30) days from the date of the letter why Decision Nos. 9526 and 9667 should not be rescinded, pursuant to section 41 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS by letter dated October 16, 1990, the applicant informed the Agency that it has no objection to the said Decisions being rescinded;

AND WHEREAS the Agency has considered the matter and is of the opinion that Decision Nos. 9526 and 9667 should be rescinded.

NOW THEREFORE, IT IS ORDERED THAT:

Decision Nos. 9526 dated February 12, 1986 and 9667 dated April 4, 1986 are hereby rescinded.
