WHEREAS under Licence No. 883170, Springhouse Aviation Ltd. (hereinafter the Licensee) is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group A, restricted to flights originating at or terminating at a point or points outside the designated area;

AND WHEREAS under Licence No. 883171, the Licensee is authorized to operate a domestic service;

AND WHEREAS by registered letter dated August 17, 1990, Licence Nos. 883170 and 883171 were suspended pursuant to subsections 97(1) and 75(1), respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), for failure by the Licensee to file with the Agency a valid certificate of insurance or evidence that it has prescribed liability insurance coverage. The Licensee was required to show cause within twenty-one (21) days from the date of the letter why Licence Nos. 883170 and 883171 should not be cancelled pursuant to subsections 97(1) and 75(1), respectively, of the National Transportation Act, 1987;

AND WHEREAS by Order No. 1990-A-556 dated October 4, 1990, Licence Nos. 883170 and 883171 were cancelled pursuant to subsections 97(1) and 75(1), respectively, of the National Transportation Act, 1987, for failure by the Licensee to either file with the Agency the required certificate of insurance or to respond to the aforementioned show cause letter;

AND WHEREAS the Agency notes that on August 27, 1990, the Licensee filed with the Agency a valid certificate of insurance, and therefore, by letter dated August 29, 1990 the suspension of Licence Nos. 883170 and 883171 was lifted;

AND WHEREAS the Agency has considered the matter and finds that Order No. 1990-A-556 was issued in error;

AND WHEREAS the Agency considers it appropriate to rescind Order No. 1990-A-556.

NOW THEREFORE, IT IS ORDERED THAT:

Order No. 1990-A-556 dated October 4, 1990 is hereby rescinded.
