IN THE MATTER OF an inquiry into the policies of Canadian air carriers regarding obstacles to the mobility of persons with a disability pursuant to sections 32 and 63.3 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) and the policies and practices of Worldways Canada Ltd. regarding carriage of persons with a disability.

WHEREAS a questionnaire was sent to 215 air carriers operating aircraft with a maximum certificated take-off weight greater than 7,500 pounds to gather information on the policies, standards, guidelines and practices of Canadian air carriers regarding carriage of persons with a disability;
AND WHEREAS a preliminary report has been tabled by the inquiry officers revealing, inter alia, that the policies of Canadian air carriers operating aircraft with 30 seats or more are discretionary and can be changed easily, that they are not enforceable and are inconsistent from one carrier to the other;
AND WHEREAS the preliminary report, which is attached as Schedule A, has been received by the National Transportation Agency (hereinafter the Agency) on May 15, 1991;
AND WHEREAS the inquiry officers found that the lack of consistency in the policies and/or practices of Canadian air carriers, regarding carriage of persons with a disability, the fact that they can change easily and the inability to enforce them may constitute an undue obstacle to the mobility of persons with a disability.
NOW THEREFORE, IT IS ORDERED THAT:
Worldways Canada Ltd. shall show cause within thirty (30) days from this Order why the Agency should not adopt the preliminary report and find that the lack of consistency in the policies and/or practices of Canadian air carriers, regarding carriage of persons with a disability, the fact that they can change easily and the inability to enforce them does not constitute an undue obstacle to the mobility of persons with a disability and why Worldways Canada Ltd. should not be ordered to implement uniform terms and conditions of carriage of persons with a disability in large aircraft (30 seats or more) as contained in Schedule B effective August 1, 1991.
