WHEREAS under Licence No. 883164, Sabourin Lake Airways Limited (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups A, B and C, from a base at Cochenour, Ontario;

AND WHEREAS by Decision No. 391-A-1990 dated July 18, 1990, the Licensee was granted authority to also use fixed wing aircraft in Group D and to change the name of the base of operations from Cochenour to Red Lake/Cochenour, Ontario, under Licence No. 883164, upon its establishing to the satisfaction of the National Transportation Agency (hereinafter the Agency) that it meets the requirements set out in paragraph 72(2)(a) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS the Licensee was provided with one year from the date of the Decision to file documents establishing to the satisfaction of the Agency that it meets the requirements set out in paragraph 72(2)(a) of the National Transportation Act, 1987;

AND WHEREAS the Licensee was advised that failure to do so would result in rescission of the Decision without further notice, effective one year from the date of the Decision;

AND WHEREAS to date the Licensee has failed to establish to the satisfaction of the Agency that it has the qualifications necessary for licence issuance;

AND WHEREAS the Agency has considered the matter and is of the opinion that Decision No. 391-A-1990 should be rescinded.

NOW THEREFORE, IT IS ORDERED THAT:

Decision No. 391-A-1990 dated July 18, 1990 is hereby rescinded.
