IN THE MATTER OF Decision No. 11086 dated October 19, 1987 - Air Transat A.T. Inc. carrying on business as Air Transat.

WHEREAS by Decision No. 11086 dated October 19, 1987, Air Transat A.T. Inc. carrying on business as Air Transat (hereinafter the applicant) was granted authority to operate a Class 9-4 International Charter commercial air service to transport persons and goods between Canada and any other country, from a base at Montréal, Quebec, using fixed wing aircraft in Group F, subject to meeting the requirements of the Canadian Transport Commission as applicable;
AND WHEREAS by letter dated November 18, 1987, the applicant was granted an extension until October 19, 1988 to meet the requirements of the Canadian Transport Commission;
AND WHEREAS by letter dated February 26, 1988, the applicant was advised of the requirements for licence issuance of the National Transportation Agency (hereinafter the Agency) and the need to comply with them by June 30, 1988 or such deadline as the Canadian Transport Commission had granted;
AND WHEREAS by letter dated August 16, 1990, the applicant was granted an extension of one year from the date of the letter to meet the requirements of the Agency with respect to licence issuance and was further advised that failure to meet the above requirements would result in Decision No. 11086 being rescinded without further notice;
AND WHEREAS to date the applicant has had sufficient time to establish to the satisfaction of the Agency that it has the qualifications necessary for licence issuance and has failed to do so;
AND WHEREAS the Agency has considered the matter and is of the opinion that Decision No. 11086 should be rescinded.
NOW THEREFORE, IT IS ORDERED THAT:
Decision No. 11086 dated October 19, 1987 is hereby rescinded.
