WHEREAS by Decision No. 172-A-1989 dated April 3, 1989, Athabaska Airways Ltd. (hereinafter the applicant) was granted authority to also use fixed wing aircraft in Group E under Licence No. 882665, upon its establishing to the satisfaction of the National Transportation Agency (hereinafter the Agency) that it meets the requirements set out in subsection 94(1) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS the applicant failed to file documents establishing to the satisfaction of the Agency that it meets the requirements set out in subsection 94(1) of the National Transportation Act, 1987;

AND WHEREAS by registered letter dated September 27, 1991, the applicant was required to show cause within thirty (30) days from the date of the said letter why Decision No. 172-A-1989 should not be rescinded;

AND WHEREAS to date the applicant has failed to either establish to the satisfaction of the Agency that it has the qualifications necessary for licence issuance or to respond to the aforementioned letter;

AND WHEREAS the Agency has considered the matter and is of the opinion that Decision No. 172-A-1989 should be rescinded.

NOW THEREFORE, IT IS ORDERED THAT:

Decision No. 172-A-1989 dated April 3, 1989 is hereby rescinded.
