IN THE MATTER OF the operation of a Class 4 Charter domestic service, a Class 9-4 Charter non-scheduled international service and a domestic service by Conquest Air Limited - Licence Nos. 882021, 882022 and 882023.

WHEREAS under Licence No. 882021, Conquest Air Limited (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group A, from a base at St. Catharines, Ontario;

AND WHEREAS under Licence No. 882022, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group A;

AND WHEREAS under Licence No. 882023, the Licensee is authorized to operate a domestic service;

AND WHEREAS Transport Canada advised the Agency that the Licensee's operating certificate was suspended effective July 6, 1990;

AND WHEREAS the Agency notes that the Licensee does not hold a valid certificate of insurance;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of Licence Nos. 882021, 882022 and 882023;

AND WHEREAS the Agency considers it appropriate to suspend Licence Nos. 882021, 882022 and 882023 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence Nos. 882021, 882022 and 882023 are hereby suspended pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).
  2. The Licensee is hereby required to show cause within thirty (30) days from the date of this Order why the said licences should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a), as applicable, of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 882021, 882022 and 882023 and shall remain affixed thereto as long as the said Order is in force.
