IN THE MATTER OF an application by the Village of Eyebrow (hereinafter the applicant) pursuant to section 202 and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3 for authority to close the "highway", namely a local road, where it crosses at grade the right-of-way and track of Canadian Pacific Limited (hereinafter the railway company), at mileage 45.06 Outlook Subdivision, in the Village of Eyebrow, in the Province of Saskatchewan.

WHEREAS the railway company has no objection to the closure and agreed to the removal of the crossing;

AND WHEREAS the Agency has reviewed the submissions filed and takes note of the agreement of the parties.

NOW THEREFORE, IT IS ORDERED THAT:

  1. The railway company is authorized to close, within the limits of its right-of-way, the crossing.
  2. The cost of closing of the crossing shall be paid by the railway company.
