IN THE MATTER OF an application by the Corporation of the City of New Westminster (hereinafter the applicant) pursuant to section 201 and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3 for authority to construct an overhead bridge to carry the "highway", namely 4th Street, across and over the right-of-way and tracks of Burlington Northern Railroad, at mileage 1.16, Front Street spur line, 9th Subdivision; Canadian National Railway Company, at mileage 0.54 Lulu Island Branch; Canadian Pacific Limited, at mileage 8.05 Westminster Subdivision; and Southern Railway of British Columbia Limited, at mileage 0.36 Fraser Valley Subdivision (hereinafter the railway companies) in the City of New Westminster, in the Province of British Columbia, as shown on Drawing Nos. 89-119-04 and 89-119-05, revision 2, both dated July, 1990, and Drawing Nos. 89-119-12 and 89-119-15, revision 3, both dated July, 1990 (hereinafter the Plans), on file with the National Transportation Agency (hereinafter the Agency).

WHEREAS the Agency has reviewed the submissions filed.
NOW THEREFORE, IT IS ORDERED THAT:
- The applicant and the railway companies are authorized to construct the overhead bridge, as shown on the Plans.
- The overhead bridge shall be constructed and maintained in compliance with the requirements of the Agency respecting highway crossings.
- Detailed plans shall be submitted to, and approved by, an Engineer of the Agency before construction is commenced.
- The cost of constructing and maintaining the overhead bridge shall be paid by the applicant.
- The railway companies shall prepare all accounts using rates not in excess of those stipulated in Schedule "A" entitled Directives, which is attached hereto, or its replacement, for all construction and maintenance work carried out by the railway companies under this Order.
