IN THE MATTER OF the construction by Lantic Sugar Limited of one 20 inch diameter low pressure steam pipeline, one 6 inch diameter low pressure steam condensate pipeline, one 4 inch diameter plant air pipeline, one 3 inch diameter instrument air pipeline, one 4 inch diameter fuel oil pipeline, one 3 inch diameter fuel oil pipeline and one 2 1/2 inch diameter low pressure steam pipeline across and over the tracks of the Canadian National Railway Company (hereinafter the railway company), at mileage 2.09 Courtney Bay Branch off mileage 0.44 Dry Dock Spur with headblock at mileage 85.39 Sussex Subdivision, in the City of Saint John, in the Province of New Brunswick, as shown on Drawing Nos. A-2400 revised December 13, 1988, A2434 revised February 6, 1989, A2463 revised November 4, 1988, A2465 revised December 12, 1988, A2466 revised December 14, 1988, A2467 and A2471 both revised December 12, 1988 and STD X01 and STD X02 both dated April 5, 1988 (hereinafter the Plans), on file with the National Transportation Agency (hereinafter the Agency).

WHEREAS the work has been carried out without obtaining an Order of the Agency pursuant to section 212 and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3;

AND WHEREAS EPCM Services Ltd., acting on behalf of Lantic Sugar Limited, has filed confirmation that the work has been carried out in accordance with the Plans;

AND WHEREAS the railway company has no objection to the work that has been carried out;

AND WHEREAS the Agency has reviewed the submissions filed, takes notes of the agreement of the parties and is of the opinion that the work should be approved pursuant to subsection 44(3) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).

NOW THEREFORE, IT IS ORDERED THAT:

  1. The work is approved.
  2. The cost of constructing and maintaining the pipeline crossing shall be paid by Lantic Sugar Limited.
