IN THE MATTER OF an application by Canadian Pacific Limited (hereinafter the applicant), pursuant to subsection 217(4) and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3, for relief from the requirement to erect and maintain fences on its Marconi Spur with headblock at mileage 124.46 Keewatin Subdivision, from mileage 0.61 to mileage 3.15, on the south side of the right-of-way, between the right-of-way and land owned by the City of Winnipeg and described as being between Chalmers Avenue and a point opposite Donwood Drive, in the City of Winnipeg, in the Province of Manitoba.

WHEREAS the Agency is of the opinion that fences along the railway are unnecessary at this location;
AND WHEREAS the Agency has reviewed the submissions filed.
NOW THEREFORE, IT IS ORDERED THAT:
The applicant is relieved from the requirement to erect and maintain fences at this location.
