IN THE MATTER OF the inquiry into the accessibility of Canadian extraprovincial motor coach services for persons with disabilities, conducted by the National Transportation Agency of Canada pursuant to section 31 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).

WHEREAS the Minister of Transport (hereinafter the Minister) requested that the National Transportation Agency of Canada (hereinafter the Agency) conduct an inquiry into the accessibility of Canadian extraprovincial motor coach services (hereinafter the inquiry);
AND WHEREAS the Minister specifically requested that the Agency, in the course of conducting the inquiry, investigate and report on the financial impact of making extraprovincial motor coach services accessible to persons with disabilities in accordance with a national standard;
AND WHEREAS the Agency has determined that it requires specific financial and operational information from motor coach operators in order to fulfil its mandate;
AND WHEREAS by letter dated May 1, 1992, the Agency requested Red Arrow Express (hereinafter the motor coach operator) to provide the Agency with certain specific financial and operational information by June 15, 1992;
AND WHEREAS the Agency has received no response from the motor coach operator to this request;
AND WHEREAS the motor coach operator was subsequently contacted to remind it of the outstanding Agency request for the information;
AND WHEREAS by letter dated July 24, 1992, the Agency required the motor coach operator, pursuant to section 18 of the National Transportation Agency General Rules, SOR/88-23 to provide the Agency with certain aspects of the information by August 4, 1992, and the remaining aspects of the information by August 31, 1992;
AND WHEREAS the motor coach operator was again contacted to remind it of the outstanding Agency request for the information;
AND WHEREAS the Agency has received no response to its requests for information.
AND WHEREAS upon consideration of the terms of reference of the inquiry and the request made by the Agency for the information.
THE AGENCY HEREBY:
- Determines that, in order to comply with the mandate with respect to the financial impact aspect of the request, the Agency must be provided with the specific financial and operational information by the motor coach operator.
NOW THEREFORE, IT IS ORDERED THAT:
Red Arrow Express shall provide the following financial and operational information to the Agency within seven days from the date of this Order:
- its audited financial statements for the years 1987-1991;
- its current interim financial statements for the year 1992;
- a statement of its revenues and expenses for the years 1987-1991 by the following operational categories:
i) scheduled intercity services,
ii) charter services,
iii) parcel express services, and,
iv) other (noting major items);
- its ridership figures (revenue and non-revenue) for the years 1987-1991, including:
i) total passengers carried,
ii) average motor coach occupancy ratio,
iii) passengers carried by route (if available),
iv) average occupancy ratio by route (if available), and
v) percentage of trips in which the coach is fully occupied;
- a statement of current fleet figures, including:
i) number of coaches by type and age,
ii) average mileage per year per coach,
iii) retirement policy in years and/or mileage, and
iv) depreciation rate of the motor coach value;
- future-oriented financial information, including:
i) projected income statements, balance sheets and statements of change in financial position for the years 1992-1994, including the set of assumptions on which these projections were based,
ii) planned capital investments, and
iii) return on equity expected;
- any funding agreements it has entered into or is intending to enter into with any government body; and
- a list of competing carriers and routes on which it competes.
