IN THE MATTER OF the operation of a Class 9-4R Restricted Charter non-scheduled international service and a Class 9-3 Unit Toll non-scheduled international service by Caribbean Air Cargo Company Ltd. doing business as Caricargo - Licence Nos. 880196 and 880726.

WHEREAS under Licence No. 880196, Caribbean Air Cargo Company Ltd. doing business as Caricargo (hereinafter the Licensee) is authorized to operate a Class 9-4R Restricted Charter non-scheduled international service using fixed wing aircraft in Group G;

AND WHEREAS under Licence No. 880726, the Licensee is authorized to operate a Class 9-3 Unit Toll non-scheduled international service using fixed wing aircraft in Group G, serving the points Hamilton, Ontario, Canada and Bridgetown, Barbados. The Licensee is authorized to transport cargo and mail only;

AND WHEREAS by registered letter dated April 30, 1993, Licence Nos. 880196 and 880726 were suspended pursuant to subsection 97(1) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987), for failure by the Licensee to file with the National Transportation Agency a valid certificate of insurance and to hold a valid operating certificate. The Licensee was required to show cause within twenty-one (21) days from the date of the letter why Licence Nos. 880196 and 880726 should not be cancelled pursuant to subsection 97(1) of the NTA, 1987;

AND WHEREAS to date, the Licensee has failed to either file with the Agency the required certificates or to respond to the aforementioned letter;

AND WHEREAS the Agency has determined that the Licensee has contravened the provisions of section 98 of the NTA, 1987 by not submitting the certificate of insurance as required;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the said licences;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to cancel Licence Nos. 880196 and 880726.

NOW THEREFORE, IT IS ORDERED THAT:

Licence Nos. 880196 and 880726 are hereby cancelled pursuant to subsection 97(1) of the NTA, 1987.
