IN THE MATTER OF the suspension of Licence No. 951314 imposed by Order No. 1996-A-449 dated October 23, 1996 - Mid-Ohio Aviation, Inc.

WHEREAS under NTA Licence No. 951314, Mid-Ohio Aviation, Inc. (hereinafter the Licensee) is authorized to operate a Class 9-4 Charter non-scheduled international service to transport traffic between points in Canada and points in the United States of America;
AND WHEREAS by Order No. 1996-A-449 dated October 23, 1996, NTA Licence No. 951314 was suspended pursuant to paragraph 75(1)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), for failure by the Licensee to file with the Canadian Transportation Agency (hereinafter the Agency) a valid certificate of insurance. The Licensee was required to show cause within thirty days from the date of the Order why NTA Licence No. 951314 should not be cancelled pursuant to paragraph 75(1)(b) of the CTA;
AND WHEREAS the Air Transportation Regulations, SOR/88-58 have been amended to simplify the various classes of air services that may be operated by a non-Canadian air carrier under a non-scheduled international licence. Accordingly, the Class 9-4 Charter non-scheduled international service operated under NTA Licence No. 951314 is now considered to be a non-scheduled international service;
AND WHEREAS the Licensee has filed a valid certificate of insurance. The Agency is satisfied that the Licensee now meets the licence issuance requirements set out in paragraph 73(1)(a) of the CTA and finds that the suspension imposed by Order No. 1996-A-449 should be lifted. In addition, the Agency considers it appropriate to issue a replacement licence to Mid-Ohio Aviation, Inc.
NOW THEREFORE, IT IS ORDERED THAT:
The suspension of NTA Licence No. 951314 imposed by Order No. 1996-A-449 dated October 23, 1996 is hereby lifted.
The Canadian Transportation Agency will issue replacement Licence No. 967416 to Mid-Ohio Aviation, Inc. authorizing it to operate a non-scheduled international service.
