IN THE MATTER OF an agreement between the Canadian Pacific Railway Company and the Corporation of the City of Vernon, pursuant to subsection 101(2) of the Canada Transportation Act, S.C., 1996, c. 10, relating to the costs of maintenance of the signals at the grade crossing at 48th Avenue and the right-of-way and tracks of the Canadian Pacific Railway Company, at mileage 44.96 Okanagan Subdivision, in the city of Vernon, in the province of British Columbia.

WHEREAS by letters dated April 8, 1997 and July 9, 1997, the Canadian Pacific Railway Company and the Corporation of the City of Vernon, respectively, indicated their agreement on the apportionment of the maintenance costs of the crossing signals;
AND WHEREAS pursuant to subsection 101(2) of the Canada Transportation Act (hereinafter the CTA), the above-noted Agreement becomes an order of the Canadian Transportation Agency (hereinafter the Agency) authorizing the parties to construct or maintain the crossing, or apportion the costs, as provided in the Agreement.
NOW THEREFORE, IT IS ORDERED THAT:
Pursuant to subsection 101(2) of the CTA, the above-noted Agreement is an order of the Agency as of July 15, 1997.
