IN THE MATTER OF an agreement between the Canadian Pacific Railway Company (hereinafter the railway company) and the District of Pitt Meadows pursuant to subsection 101(2) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), relating to the reconstruction of the crossing at grade and the modification of the crossing warning signal system at Kennedy Road and mileage 109.42 Cascade Subdivision, in the district of Pitt Meadows, in the province of British Columbia.

On March 27, 1998, the Canadian Transportation Agency (hereinafter the Agency) received a letter from the railway company dated March 17, 1998, which enclosed a copy of an executed Agreement dated February 9, 1998 between the railway company and the District of Pitt Meadows with respect to the work set out in the title.
Pursuant to subsection 101(2) of the CTA, the above-noted Agreement becomes an Order of the Agency authorizing the parties to construct or maintain the crossing, or apportioning the costs, as provided in the Agreement.
Accordingly, pursuant to subsection 101(2) of the CTA, the above-noted Agreement is an Order of the Agency as of March 27, 1998.
