BACKGROUND
In its Decision No. 356-AT-A-1999 dated June 21, 1999, the Canadian Transportation Agency (hereinafter the Agency) made a determination with respect to an application filed by Elliott Richman on February 19, 1999.
The application pertained to the absence of a TTY (telephone-teletype device for persons who are deaf or hard of hearing) reservation number in Bearskin Lake Air Service Ltd.'s (hereinafter Bearskin Airlines) timetable.
The Agency concluded that given the size and nature of Bearskin Airlines' operations, the absence of a TTY reservation number constituted an undue obstacle to Mr. Richman's mobility.
In its Decision No. 356-AT-A-1999, the Agency therefore required Bearskin Airlines to complete the installation of a TTY reservation line within sixty (60) days from the date of the Decision and to provide confirmation of such to the Agency upon completion.
Bearskin Airlines was also required to ensure that the TTY number is included in all seat sale advertisements and in all future publications providing information about the carrier that is otherwise available to the general public.
ISSUE
The issue to be determined by the Agency is whether the measures taken by Bearskin Airlines satisfy the requirements of Decision No. 356-AT-A-1999 dated June 21, 1999.
FACTS
On August 12, 1999, Bearskin Airlines advised the Agency that a TTY line had been added to its Reservations Department, and that staff were required to familiarize themselves with its operation by August 16, 1999.
Bearskin Airlines further advised that, upon reprinting, all advertising will make reference to the new TTY service available to persons with a hearing impairment.
ANALYSIS AND FINDINGS
The Agency has considered the information provided by Bearskin Airlines and confirmed that the carrier has installed a TTY in accordance with the requirements of Decision No. 356-AT-A-1999 dated June 21, 1999. The Agency is satisfied that the measures taken by Bearskin Airlines should improve direct communication between persons with a hearing disability and the carrier, thereby eliminating undue obstacles to their mobility and improving access to the federally regulated air transportation network.
CONCLUSION
In light of the above, the Agency contemplates no further action in this matter.
