IN THE MATTER OF an agreement between the Canadian National Railway Company and the Rural Municipality of Ituna Bon Accord pursuant to subsection 101(2) of the Canada Transportation Act, S.C., 1996, c. 10, relating to, among other matters, the construction of an extension to a siding track running between mileages 41.83 and 44.24 Watrous Subdivision, in the rural municipality of Ituna Bon Accord, in the province of Saskatchewan.

On January 17, 2002, the Canadian Transportation Agency (hereinafter the Agency) received a letter from the Canadian National Railway Company dated January 14, 2002, which enclosed a copy of an executed Agreement entered into by itself and the Rural Municipality of Ituna Bon Accord, with respect to the work set out in the title.

Pursuant to subsection 101(2) of the Canada Transportation Act (hereinafter the CTA), the above-noted Agreement becomes an order of the Agency authorizing the parties to construct or maintain the crossing, or apportioning the costs, as provided for in the Agreement.

Accordingly, pursuant to subsection 101(2) of the CTA, the above-noted Agreement is an Order of the Agency as of January 17, 2002.
