IN THE MATTER OF an agreement between the Canadian National Railway Company, the ministère des Transports of the Province of Quebec and Ville de Saint-Félicien pursuant to subsection 101(2) of the Canada Transportation Act, S.C., 1996, c. 10, relating to the reconstruction and maintenance of the road crossing at boulevard Sacré-Coeur and mileage 27.19 Roberval Subdivision, in the city of Saint-Félicien, in the province of Quebec.

On February 7, 2005, the Canadian Transportation Agency (hereinafter the Agency) received a letter from the Canadian National Railway Company dated January 31, 2005, which enclosed a copy of an executed Agreement entered into by itself, the ministère des Transports of the Province of Quebec and Ville de Saint-Félicien, with respect to the work set out in the title.

Pursuant to subsection 101(2) of the Canada Transportation Act (hereinafter the CTA), the above-noted Agreement becomes an order of the Agency authorizing the parties to construct or maintain the crossing, or apportioning the costs, as provided for in the Agreement.

Accordingly, pursuant to subsection 101(2) of the CTA, the above-noted Agreement is an Order of the Agency as of February 7, 2005.
