IN THE MATTER OF the proposed tariff of pilotage charges published by the Great Lakes Pilotage Authority in the Canada Gazette Part I edition of May 20, 2006; and

IN THE MATTER OF the notice of objection filed by the Canadian Shipowners Association.

A notice of objection to the proposed tariff of pilotage charges as published by the Great Lakes Pilotage Authority (hereinafter the Authority) have been filed with the Canadian Transportation Agency (hereinafter the Agency).

The Agency is, pursuant to section 34 of the Pilotage Act, required to make an investigation of the tariff proposal against which a notice of objection has been filed.

The Agency, in the proper discharge of its investigation, requires certain information, particulars and documents relating to the operation and administration of the Authority.

Pursuant to section 18 of the Canadian Transportation Agency General Rules, SOR/2005-35:

  1. The Authority shall produce and file with the Agency, by July 28, 2006, the information, particulars and documents listed in the attached Schedule "A".
  2. The information, particulars and documents listed in Schedule "A", which are not considered to be of a confidential nature, shall be made available, if requested, to the parties of record with the reproduction cost and delivery to be borne by the party making the request.

SCHEDULE "A"

INFORMATION, PARTICULARS AND DOCUMENTS TO BE PROVIDED BY THE AUTHORITY:

  1. Description of any other tariff amendments considered by the Authority to generate additional revenue and the reasons for selecting the current tariff proposal rather than another tariff proposal.
  2. Statement of financial results showing itemized revenues and expenses for each of 2003, 2004 and 2005, along with projected results for 2006 and 2007.
  3. Annual report to the Minister of Transport for each of 2003, 2004 and 2005.
  4. Public summary of the most recent corporate plan.
  5. Copy of the most recent report by the Office of the Auditor General.
  6. The rationale for dividing vessels into the current four classes and the rationale for the weighting factor for each class that is applied to the pilotage charges.
  7. All financial analyses carried out by the Authority to demonstrate that Class 1 vessels are not paying the full cost of pilotage services provided. Similarly, all financial analyses carried out comparing the costs and revenues for the Class 2, 3 and 4 vessels.
  8. Pilotage assignments for each of 2003, 2004 and 2005, along with projections for 2006 and 2007.
  9. Pilot strength, number of pilot retirements and number of apprentice pilots hired in each of 2003, 2004 and 2005, along with projections for 2006 and 2007.
  10. Number of vessel assignments in each of Class 1, 2, 3 and 4 for each of 2003, 2004 and 2005, along with projections for 2006 and 2007.
  11. Number of vessel pilotage units in each of Class 1, 2, 3 and 4 for each of 2003, 2004 and 2005, along with projections for 2006 and 2007.
  12. Annual revenue from Class 1, 2, 3 and 4 vessels for each of 2003, 2004, 2005, along with projections for 2006 and 2007.
