Order No. 2012-A-3

January 5, 2012

APPLICATION by Swanberg Air Inc. carrying on business as Western Pacific Airlines to continue the suspension of Licence Nos. 980041 and 000134.

File No.:
M4210/W271-1

In its Order No. 2011-A-525, the Canadian Transportation Agency (Agency), pursuant to subsection 63(1) and paragraph 75(1)(a) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), suspended the domestic and non-scheduled international licences of Swanberg Air Inc. carrying on business as Western Pacific Airlines (Licensee).

In response to the Order, the Licensee has requested that the licences remain suspended and not be cancelled.

Having considered the application, the Agency orders that the licences remain suspended.

To reinstate the licences, the Licensee is provided with one year to file an application. If, at that time, the Agency concludes that the Licensee meets all the applicable requirements of the CTA, the Agency will reinstate the licences.

If within one year the application for reinstatement is not filed or the Licensee does not meet any of the applicable requirements of the CTA, the Licensee is provided with an additional 30 days following the expiry of one year to show cause why the licences should not be cancelled.
