Decision No. 207-AT-W-2006
March 31, 2006
IN THE MATTER OF Decision No. 449-AT-W-2005 dated July 12, 2005 - Elliott Richman vs Scotia Prince Cruises Ltd. (formerly Prince of Fundy Cruises Limited).
File No. U 3570/00-1
BACKGROUND
In its Decision No. 449-AT-W-2005 dated July 12, 2005 (hereinafter the Decision), the Canadian Transportation Agency (hereinafter the Agency) directed Scotia Prince Cruises Ltd. (formerly Prince of Fundy Cruises Limited) (hereinafter Scotia Prince) to show cause why it should not be required to install TTY (telephone-teletype device for persons who are deaf or hard of hearing) access with respect to its Canadian reservation system.
In a letter addressed to Scotia Prince dated December 5, 2005, Agency staff noted that the carrier had not responded to the show cause directive contained in the Decision. Accordingly, Scotia Prince was afforded an opportunity to provide an update on the status of the installation of a TTY with respect to its Canadian reservation system.
The carrier did not respond to the December 5, 2005 letter. The Agency was not able to establish contact by telephone. Scotia Prince's Web site indicates that the lack of appropriate facilities at its International Marine Terminal at Portland, Maine forced it to cancel its 2005 sailing season.
ISSUE
The issue to be addressed is whether the Agency is satisfied with the measures taken by Scotia Prince in response to Decision No. 449-AT-W-2005.
ANALYSIS AND FINDINGS
The Agency notes that Scotia Prince did not respond to the show cause directive.
The Agency has reviewed the information posted on Scotia Prince's Web site, including the statement that it appears unlikely that the carrier will resume service to Nova Scotia and, in light of this, the Agency contemplates no further action in this matter.
CONCLUSION
Accordingly, the file is now closed.
