APPLICATION by Aerovias del Continente Americano S.A. carrying on business as Avianca pursuant to subsection 78(2) of the Canada Transportation Act, S.C., 1996, c. 10, as amended.
Aerovias del Continente Americano S.A. carrying on business as Avianca (Avianca) has applied to the Canadian Transportation Agency (Agency) for a temporary licence to operate an international air service on a scheduled basis between Colombia and Canada.
Avianca is licensed to operate an international air service on a scheduled basis, limited to four flights per week, between Colombia and Canada.
Condition No. 2 of the licence states:
This licence shall terminate on October 31, 2011.
The authority requested by Avianca is extra-bilateral because there is no agreement or arrangement between Colombia and Canada which provides for the operation by an air carrier of a scheduled international air service between Colombia and Canada.
Prior to operating an international air service, Avianca must, in addition to holding a licence, hold a valid Canadian aviation document and have the prescribed liability insurance coverage. The Agency is satisfied that Avianca meets those requirements.
Concerning the duration of the subject authority, the Agency considers it appropriate to grant it until October 31, 2012.
Accordingly, the Agency, pursuant to subsection 78(2) of the Canada Transportation Act, varies Condition No. 2 of the licence to read:
This licence shall terminate on October 31, 2012.
Any similar requests for a subsequent authority shall be submitted to the Agency for approval one month prior to the expiry of the licence.
