Decision No. 377-A-2011
The suspension is no longer in effect by
APPLICATION by Carcajou Air Ltd. for suspension of Licence No. 970117.
Carcajou Air Ltd. (Licensee) is licensed to operate a domestic service, small aircraft.
The Licensee has applied for a suspension of licence pursuant to paragraph 63(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA).
However, as the Licensee does not have the prescribed liability insurance coverage, the Canadian Transportation Agency (Agency) has determined that this application should be dealt with pursuant to subsection 63(1) of the CTA which requires the Agency to suspend licences when licensees fail to meet the requirement of subparagraph 61(a)(iii) of the CTA.
As the Licensee ceases to meet this requirement, the Agency, pursuant to subsection 63(1) of the CTA, suspends the licence.
To reinstate the licence, the Licensee is provided with one year to file an application. If, at that time, the Agency concludes that the Licensee meets all the applicable requirements of the CTA, the Agency will reinstate the licence.
If within one year the application for reinstatement is not filed or the Licensee does not meet any of the applicable requirements of the CTA, the Licensee is provided with an additional 30 days following the expiry of one year to show cause why the licence should not be cancelled.
