IN THE MATTER OF a complaint by John Elliott pursuant to subsection 172(1) of the Canada Transportation Act, S.C., 1996 c. 10 regarding seat assignment and the level of assistance provided by Reno Air Inc. during boarding, deplaning and in-flight when he travelled between Vancouver, British Columbia and Reno, Nevada on October 24 and 28, 1998.

COMPLAINT
On March 4, 1999, John Elliott filed a complaint with the Canadian Transportation Agency (hereinafter the Agency) with respect to the matter set out in the title.
On April 1, 1999, Reno Air Inc. provided its answer to the complaint and Mr. Elliott filed his reply on April 9, 1999.
On June 9, 1999, Mr. Elliott advised that he had resolved the complaint directly with Reno Air Inc. and agreed that no further action was necessary.
CONCLUSION
The Agency takes note of Mr. Elliott's withdrawal of his complaint and does not consider it appropriate to fix any terms and conditions pursuant to subsection 37(3) of the National Transportation Agency General Rules, SOR/88-23.
