Dryden Flight Centre Ltd. carrying on business under the firm name and style of Dryden Flight Charters (hereinafter the applicant) has applied to the National Transportation Agency for the suspension set out in the title. The application was received on August 17, 1988.
Under Licence No. 880244, the applicant is authorized to operate a domestic service; and under Licence No. 880245, a Class 4 Charter domestic service using fixed wing aircraft in Groups A and B, from a base at Dryden, Ontario.
Under Licence No. A.T.C. 878/84(CF), the applicant is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group A, from a base at Dryden, Ontario.
By letter dated August 12, 1988, the applicant has requested the suspension of Licence Nos. 880244, 880245 and A.T.C. 878/84(CF) until August 1, 1989.
It is noted that, pursuant to subparagraph 109(2)(d)(iii) of the National Transportation Act, 1987, S.C. 1987, c. 34, Licence No. A.T.C. 878/84(CF) is deemed to be a licence issued pursuant to section 94 of the National Transportation Act, 1987.
The Agency has reviewed the application with respect to Licence Nos. 880244 and 880245 and considers it appropriate to suspend these licences until August 1, 1989. The application with respect to Licence Nos. 880244 and 880245 is hereby approved.
Licence Nos. 880244 and 880245 are hereby suspended, pursuant to subsection 75(2) of the National Transportation Act, 1987, until August 1, 1989.
The Agency has reviewed the application with respect to Licence No. A.T.C. 878/84(CF) and considers it appropriate to suspend this licence. The application with respect to Licence No. A.T.C. 878/84(CF) is hereby approved with modification. Although the applicant requested suspension of this licence until August 1, 1989, the Agency is unable to do so as licences issued under Part II of the Aeronautics Act remain in effect for a period not exceeding twelve months after January 1, 1988, as set out in section 109 of the National Transportation Act, 1987.
Accordingly, Licence No. A.T.C. 878/84(CF) is hereby suspended, pursuant to subsection 97(2) of the National Transportation Act, 1987, until December 31, 1988. Dryden Flight Centre Ltd. carrying on business under the firm name and style of Dryden Flight Charters is required to satisfy the Agency, on or before December 1, 1988, that it has the qualifications, as set out in Part II of the National Transportation Act, 1987, necessary for issuance of a licence that is an appropriate replacement for its previously held licence.
This Decision shall form part of Licence Nos. 880244, 880245 and A.T.C. 878/84(CF) and shall remain affixed thereto as long as the said Decision is in force.
